Holder pushes Democrats to consider reforming 'broken' Supreme Court

Former Attorney General Eric Holder pushed for Democrats to consider reforming a “broken” Supreme Court in a recent podcast interview.

“I think, you know — the reality is, it pains me to say this — I think the Supreme Court is a broken institution, and it's something that has to be, I think, a part of the national conversation in ‘26 and in ‘28, ‘What are we going to do about the Supreme Court?'” Holder said on “The MeidasTouch Podcast,” in an interview highlighted by Mediaite.

“And I think that we have to think about, again, talking about the acquisition and the use of power, if there is a Democratic trifecta in 2028 — and I think the possibility of that is pretty good — Supreme Court reform is something that has to be considered,” he added.

Democrats have directed their ire at the conservative-dominated Supreme Court in recent years for decisions such as those overturning Roe v. Wade and in President Trump’s immunity case.

In 2019, Holder said that the next Democratic president should look into packing the country’s highest court by adding additional seats.

Former President Biden in July 2024 slammed “extreme opinions” at the Supreme Court when announcing major court reform proposals in a speech at the time.

“I have great respect for our institutions, the separation of powers laid out in our Constitution,” Biden said previously. “What’s happening now is not consistent with that doctrine of separation of powers. Extremism is undermining the public confidence in the court’s decisions.”

Biden’s speech followed his announcing in an op-ed a three-part proposal for Supreme Court reform. He pushed for term limits on justices, a binding code of ethics and a constitutional amendment to go against the justices’ presidential immunity decision.
